War Crimes, such as Crimes Against Humanity, cannot be charged for offenses that occurred before conflict began BUT...
"...the United States could not institute a military tribunal within its own jurisdiction to pass upon violations of the laws and customs of war, unless such violations were committed upon American persons or American property..."
War Crimes/Crimes Against Humanity [traitors/spies violating the Constitution: census, voting, apportionment] on American property or people allows for military tribunals.
To charge Crimes Against Humanity before the conflict began, it must have been executed within jurisdiction of the tribunal, aka American property or people.

Why were Nazi atrocities not "Crimes Against Humanity" before the war began?
“To constitute Crimes against Humanity, the acts relied on before the outbreak of war must have been in execution of, or in connection with, any crime within the jurisdiction of the Tribunal. The Tribunal is of the opinion that revolting and horrible as many of these crimes were, it has not been *satisfactorily proved* that they were done in execution of, or in connection with, any such crime. The Tribunal therefore cannot make a general declaration that the acts before 1939 were Crimes against Humanity within the meaning of the Charter, but from the beginning of the war in 1939 War Crimes were committed on a vast scale, which were also Crimes against Humanity;"
Basically, the deep state can be charged for Crimes Against Humanity prior to military occupation from the earliest point that crimes can be *proven* to have knowingly occurred on American people or soil and against the Constitution. No statute of limitations.
Census fraud [knowingly] by foreign infiltrators to apportion unconstitutionally House representatives, unbalanced and unfairly, to make laws and commit election fraud.
